The Social Security Disability Appeals Process
The Social Security disability appeals process takes some times and patiences, so, be prepared.
If you are just starting to file for your Social Security benefits this will take some time. Like all government actions, patience is what you need for this process. The first time filers are denied 2/3 of the time as a general rule. You know you are disabled but they don't. Unless, your case is cut and dried you will be denied.
Don't let this discourage you from filing a disability appeal. They are banking you don't know you can file for a second time. But, you can and should. If you feel you deserve disability then pursue it completely. Many people get discouraged and take it personally and you shouldn't. There are so many fraudulent claims sent in that they are denying most of them the first time you apply.
You should hear something about your first filing in about 3 to 5 months. Sometimes they come back sooner but not usually. This will or could be your first denial letter. You have 60 days to appeal this decision. This decision usually takes 3 months before you hear anything. This is called a Reconsideration filing. Go ahead and re-file as soon as possible. Don't wait until you run out of time, this could cost you dearly.
If this time you are successful, HOO-RAYY! You have won and the fight is over. Congratulations!! But--- If you receive a second denial, you have another option. Re-file again; yes again, only this time request to go before an Administrative Law Judgefor a
hearing
. This is where you get to tell what has happened. Don't exaggerate your problem. The judge is likely to see right through you. Just state the facts of your case and hopefully all will go well. At this hearing you are able to take your spouse, family members that are relevant to your case, friends (who know what you have been through) or anyone that you feel will help your case to win. Remember, this is just a hearing and not like a court room trial. Don't take a lot of people with you, just the relevant ones.
One other thing - Do Not Be Late. The judge will probably postpone your hearing until a reschedule date has been made. This could take another 60 days.
So, above all, be on time or a little early.
